SECTION 4.
Sir J. Jordan to Sir Edward Grey.-(Received February 22,)
(No. 13.)
Peking, January 7, 1908. Sir,
WITH reference to my despatch No. 591 of the 24th ultimo, I have the honour to forward to you herewith copy of a further despatch and its inclosures which I have addressed to His Majesty's Ambassador at Tókið on the subject of the imitation and use in China by Japanese of British trade-marks.
I have, &c. (Signed) J. N. JORDAN.
Inclosure 1 in No. 1.
Sir J. Jordan to Sir C. MacDonald.
Peking, January 6, 1908. IN continuation of my despatch of the 23rd December last, I have the honour to forward to your Excellency herewith copies of despatches which I have since received from His Majesty's Consul-General and the Acting Commercial Attaché at Shanghae on the subject of the imitation and use in China by Japanese of British trade-marks.
The despatch from Sir Pelham Warren, which forms Inclosure 1 in this despatch,* incloses copy of a letter from the local branch of the China Association, in which the Secretary records a number of marks taken from the publication "A Complete List of the Trade-marks registered at the Japanese Patent Office," which he considers to be imitations of British marks. Your Excellency will notice from the semi-official letter from Sir A. Hosie, copy of which I also have the honour to inclose, that while he considers this list to be short and incomplete, he is of the opinion that it will be added to as time goes on.
From a further semi-official letter which I have received from Sir A. Hosie, copy of which is also enclosed, your Excellency will observe that the China Association are using every effort to secure specimens of counterfeits and imitations. The newspaper extracts forwarded in this letter show recognition by the Japanese authorities of the fact that there has been a practice of fraudulent use by their countrymen of foreign trade-marks in China.
In Sir A. Hosie's despatch No. 11 of the 26th ultimo, Inclosure 4 in this despatch,† he forwards a jar of Gosnell and Co.'s Tooth Paste, together with a Japanese imitation. I am forwarding these to your Excellency by parcels post.
Copy of this despatch is being sent to His Majesty's Principal Secretary of State for Foreign Affairs.
(No. 141.) Sir,
I have, &c.
(Signed) J. N. JORDAN.
Inclosure 2 in No. 1.
Consul-General Sir P. Warren to Sir J. Jordan.
Shanghae, December 16, 1907. IN continuation of my despatch No. 140 of the 9th instant with reference to the imitation and use in China by Japanese of British trade-marks, I have the honour to inclose a copy of a further letter on the subject which I have received from the local branch of the China Association.
